Family residence permit is regulated under Articles 34 and 37 of the Law on Foreigners and International Protection. These provisions are short-term residence permits given to foreign nationals for the purpose of protecting and continuing family unity. It is provided to foreign nationals with family status.
Persons who are married to a Turkish citizen or have a foreign spouse holding a work permit and their children under the age of 18 can apply for family residence. It should be noted here that in order to apply for family residence through the foreign spouse who has a work permit, the foreigner holding a work permit must already have a work permit for 1 year.
It should also be noted that the person who will apply for family residence due to his spouse must have entered Turkey with a Family Reunification Visa, which is one of the special legal visa types, while entering from abroad.
How to Obtain FR ?
Turkey provides convenience to foreign nationals in the process of obtaining a family residence permit. Apart from foreigners who are married to a Turkish citizen, foreigners married to foreigners who have a legal residence permit or secondary protection status in Turkey can also apply.
While a person may be in a supporting role and obtain residence permits for their spouse and children, they can also provide family residence permits to their spouse’s children (non-his own children).
Persons who are entitled to Turkish citizenship by birth, those who leave their citizenship by obtaining permission to renounce their citizenship and their children benefit from the advantages of family residence permit by protecting their social security rights, provided that they comply with the conditions of public order and security.
Who Can Get a Family Residence?
Turkish citizens, foreigners holding one of the residence permits and holders of secondary protection status;
• To his foreign spouse.
-Minor foreign child of himself or his spouse.
• The dependent foreign child of himself or his spouse.
A family residence permit period can not exceed 3 years. The duration of the family residence permit cannot exceed the duration of the sponsor’s residence permit in any way.
FR Application Period
Foreigners must apply for a family residence permit without exceeding the visa or visa exemption period. Foreigners who enter Turkey with a visa exemption have the right to stay for a maximum of 90 days and must apply for a family residence permit before this period expires.
How Long Does It Take for a FR?
The duration of the family residence application may vary depending on the place where the application is made and the density. It is notified to the foreigner by the official institutions of Turkey, within 90 days of this period.
How to Get Approved FR?
After the application process is completed, the approved family residence permit is sent to the residence address of the foreigner by the Directorate of Migration Management. PTT delivers the document to the foreigner’s phone number, which is verified, and delivers within 1 to 3 working days.
Reasons for Refusal, Cancellation and Non-Extension of FR
• It is determined that the family residence is used for purposes other than its issuance,
– Failing to fulfill or disappearing the conditions sought for family residence,
• Family residence permit cannot be obtained in cases where there is a valid deportation decision or an entry ban. Existing residence permits are not canceled or extended.
Can a Person With Family Residence Work?
For foreigners who have a family residence permit who want to work in Turkey, this permit alone is not sufficient. Unless there are different provisions in the contracts to which Turkey is a party, foreigners must obtain a work permit in order to be able to work independently or independently. They can also apply for an exceptional work permit for exceptional circumstances. Foreigners holding a family residence can request an exceptional work permit in Turkey, without the condition of residence.
How Long Can a Family Residence Be Obtained?
Family residence is given to the foreigner for a maximum of 3 years, taking into account the passport duration, depending on the insurance and job status of the supporting or sponsoring spouse.
How to Renew Family Residence ?
In the family residence renewal application, the income status of the supporting or sponsor spouse, insurance and the passport duration of the foreigner are taken into consideration. When less than 120 days remain until the expiry of the family residence, a renewal application must be made. Applications made after the expiry of the family residence period are considered as a new application.
